For a Hindu it is believed that marrying with any woman automatically changes wife's name and her kids name ... but legally something is to be done yet...
If the male , who is kidless or female is not having an issue .... Can adopt a male or female child from orphanage or from own relatives , kiths keens after adopting son/daughter parent’s approval...
I married a widow with a kid ... and wanted to give all possible pleasures to the family and to take all the pleasures of family hood... so did following important things...
It has taken lot of consultations, hurdles , time consuming , irking behaviors of some stone faces and all with some sparks of acclaiming too.
If kid is below 15 that is before the board exams let us put it Xth Std.
This is best done...
*Do religious ceremony for the relatives and myths .....The acceptance in family increases....
Then
*Apply in court for custody of the kid ... even one is married to the same persons who is mother or father of the CHILD..
Most important : for Gujarat govt. procedures....
* Apply for a Dattak Vidhan ... adoption deed दत्तक विधान
To be done at registrar office where
wills , deeds ,property transfers are registered..
Where photo scanning Thumb impression will be done... too
Consenting mother or parent.. Courts verdict saying yes ... justification in doing so... if one has kids cannot adopt...
*After this registration the certified copy ... along with remarriage certifs.. cause of proof for why single parents , court order , THIS DATTAK DEED / VIDHAN it is to be sent to Rajkot for Gadgets publication .. where every Thursday govt . Gazettes are published where in name change will be published in turn...
*Court took 45 Days Schedule granting the petition for adoption as per routine ... as there were no objections.. In case of controversies ... court's verdict is FINAL.
*The publication in gazettes is taking 1 month on avg. for name transfer...
*By paying necessary fees one gets the copy of gadgets at home address...
*Now the name of wife and son both gets changed... and they are allowed legally to do so..
*For educational, social , property deal purposes , passport purposes and so on...
*After the gazette publications
Changed name publications DEO District Education Officer શિક્ષણાધિકારી શ્રી, અમદાવાદ જિલ્લો શહેર.. Was applied via school with necessarydiff form filling .... Notary once again.. In due course we received YES Father Name change and surname change .. took place...Time.... they first attend 12 then 10 and lower down... done at snail pace.. but on demand and personal follow up can be done faster///
In my case.. After approaching DEO only within 72 Hrs I got the required letter.
ONE MORE formality still remains ..... Where father's name change is to be honored by metropolitan magistrate court No 8 in my case other is Court No 6 at old collector office relief road.... and this one in Municipal KOTHA....
Order to change the certificates ... or to amend the certificates this two are authorized and geographical distribution wise they control birth registrar office... and authority to change...
Pass port people will take some hitches or would go through straight after this ... will be smooth sailing hopefully ... would like to up date..
The schools (esspecially central school Board )in my case MISGUIDED me a LOT...
Saying son's name cannot be transferred... father's name is genetic name and generic name is FINAL and so on..Then they changed it to ... It cannot be done at our level... THE DELHI PEOPLE WILL ASK U TO DO THOSE PROCEDURES ... all half hearted truths ...
I am forced to write on blog about this... as this may be giving a lot of guidance... as ironically mother's name gets changed faster .... Schools starting and fathers name transfer in pipe line...... After marriage ... especially remarriage,,,,, this kind of social synthesis and bridging should be fast done...
